Regular Meeting - September 24, 2001 at 7:30 PM

Chairperson Mitchell called the meeting to order at 7:30 PM

Public Hearing

1. Barbara and Mitchell Messina - 6 High Street - Re-subdivision and Addition
Present:

Proposed: Re-subdivision of properties located at #2 and #4 with #6 High Street.
The secretary read the legal notice that was published in the Brighton-Pittsford Post on
September 5, 2001:

Please take notice that a Public Hearing will be held before the Village of Pittsford Planning and Zoning Board of Appeals on Monday, September 24, 2001, to consider an application made by Barbara and Mitchell Messina, owners of the property located at 2 & 4 High Street (tax map #151.18-1-8.1) and 6 High Street (tax map #151.18-1-7) for resubdivision approval for purposes of combining the above listed two parcels into one parcel, pursuant to Chapter 210-83, Zoning, of the Code of the Village of Pittsford.

The legal notice having been read, Chairperson Mitchell opened the Public Hearing.

SEQR: Type II Action, 617.5 This is not subject to review under the Environmental Conservation Law.
Discussion: The resident intends to combine the two properties (#2, #4 and #6 High Street) into one parcel with the intent of building a two story addition on the patio site at the rear of the home. These two parcels are six tax properties (three Town and three Village). This application is not a "hardship" and a variance is not required if the lots were combined. The owners intend is to keep it as a single use residence. They have been before the APRB informally with construction plans for their addition.

The Department of Planning and Development has sent a letter indicating that the New York State Department of Transportation has reviewed this project and has no comment.

No letters or phone calls were received regarding this application.

Chairperson Mitchell had closed the public hearing with respect to this application.

Findings of Fact 1: 1. There are no adverse effects to the community by allowing the combinations of these properties. 2. Enlarging the existing single family dwelling requires either the resubdivision of these parcels or a zoning variance.
Motion: Chairperson Mitchell made a motion, seconded by Member Danko, to approve the re-combination of lots #2, #4, and #6 High Street. The stipulation being it remain a single-family dwelling and be recorded as a re-subdivision
Vote: Mitchell - yes; Lanphear - yes; Danko - yes Motion Carried
The decision was filed in the Office of the Village Clerk 9/24/01.
2. Messner Carpeting - 19 Monroe Avenue - Commercial Lighting

Lighting for new sign

The secretary read the legal notice that was published in the Brighton-Pittsford Post on
September 6, 2001:

Please take notice that a public hearing will be held before the Village of Pittsford Planning Board at the Village Hall, 21 North Main Street, Pittsford, New York, on Monday, September 24, 2001 at 7:30 P. M. to consider an application made by Messner Carpeting, 19 Monroe Ave., Pittsford, NY, for approval for exterior lighting on their sign at said location pursuant to Chapter 117-6, Lighting, Exterior of the Code of the Village of Pittsford.

The legal notice having been read, Chairperson Mitchell has opened the Public Hearing.

SEQR: Type II Action, 617.5, #7 and #15
Discussion: Owner is proposing two gooseneck lights (Maynards: Gooseneck brackets: WM-GN56-SPF with the "Emblem Sign" lamps) shining above the two signs (Messner Carpeting and tenant, State Farm). Each sign is 3' x 6'. Gooseneck lights will be utilizing outside power (previously installed by the post office) for wiring which can run behind the molding at the top of the brick wall, keeping it hidden, and installing the two boxes on the fascia board. Lighting packs are designed to beam down. Trim around doors and windows, doors, and fascia board will be painted. Signs were previously approved. The opinion of lighting expert from Maynards is being sought. The Board stated that a variance was not required. APRB has given conditional approval for lighting fixtures pending the Planning and Zoning approval.

No letters or phones were received regarding this application.

Chairperson Mitchell had closed the public hearing with respect to this application.

Findings of Fact:

This application meets the guidelines for exterior lighting as specified by Code.

Motion: Chairperson Mitchell made a motion, seconded by Member Danko, to approve the Messner Carpeting application regarding four gooseneck lamps to be placed two over each sign on the front facade of the Messner Carpeting building as shown on the application.
Vote: Mitchell - yes; Lanphear - yes; Danko - yes Motion Carried

3. Jefrey Mason - 50 State Street - Northfield Common Sign Re-location
Present: Jeff Mason
Proposed:

Site plan approval for sign relocation.

The secretary read the legal notice that was published in the Brighton-Pittsford Post on
September 6, 2001:

Please take notice that a public hearing will be held before the Village of Pittsford Planning Board at the Village Hall, 21 North Main Street, Pittsford, New York, on Monday, September 24, 2001 at 7:30 P. M. to consider an application made by Northfield Common Associates, 50 State Street and Jefrey Mason, 68 State Pittsford, NY, for plan approval for the relocation of the free standing sign at 50 State Street pursuant to Article XVII, Chapter 210-83, Site Plan Approval, of the Code of the Village of Pittsford.

The legal notice having been read, Chairperson Mitchell opened the Public Hearing.

SEQR: Type II Action, 617.5, #15
Discussion: Mr. Mason is requesting to relocate the Northfield Common sign due to a visibility issue. The sign was moved when the bridge was replaced. The new placement will be set back 6 feet from the curb on Schoen Place on Mr. Mason's personal property and approximately 105' from State Street. It will be placed somewhat behind the large rock. Traffic safety and visibility concern are not a problem. The existing sign will be restored. The posts will be kept. The overall sign height will be 5'8" x a width of 6'6". It will have a medina stone foundation with a surround stone of about 2'. The size and shape of the sign will remain the same or be modified slightly. Building inspector Skip Bialey stated this was a minor change and zoned B1. It is a pre-existing use as commercial. The application is scheduled to be reviewed by the APRB 10/1/01 pending this board's approval.

The issue of Chairperson Mitchell's ability to vote on this application was discussed. In view of the Board, the applicant, and the attending public, Chairperson Mitchell stated she is a shop owner at Northfield Common and a tenant to Mr. Mason. She asked if there were any objections in her voting participation regarding this application. There were no objections stated from all attending parties.

Public Comments: Jane Botelho, 66 State Street, Pittsford, N Y 14534 has no objection to the sign's relocation.
Jennifer Rube, Shop owner at Northfield Common, stated the sign's relocation was first proposed by the Mayor.

Chairperson Mitchell had closed the public hearing with respect to this application.

Findings of Fact: 1. This sign was originally located on the site which the applicant has requested relocating it. 2. Northfield Common does not have a street sign identifying it by name. The existing intersection sign reads "Schoen Place".
Motion: Member Danko made a motion, seconded by Member Lanphear, to approve Jefrey Mason's application of the Northfield Common sign site plan for the relocation of the free standing sign.
Vote: Mitchell - yes; Lanphear - yes; Danko - yes Motion carried

BUILDING INSPECTOR'S REPORT
1. No zoning issues to report.
2. Aladdin's retaining wall: It is undetermined whether it is a landscaping issue or a site issue.
3. Phoenix Building: Mike Newcomb was sent a Violation Notice regarding the retaining wall.

MEMBER ITEMS 

  1. Speigel Center: Member Danko presented a letter he wrote to the Town of Pittsford regarding the Speigel Center focus group he attended. A discussion followed regarding the Speigel Center's and the Pittsford Library's vital importance to the Village.
  2. Mr. & Mrs. Burris: The APRB has submitted draft responses to the Planning and Zoning questions. A complete and formal response will be given upon the Burris's appeal should one be requested. A legal notice will need to be re-published.
  3. Board has requested copies of the final edition of the "Plans" packet that will be used for presentation by the Comprehensive Plan on October 17, 2001.
